Welcome to CanProTrades.ca ("CanProTrades," "we," "our," or "us"). By accessing or using this website and its services, you ("User," "Client," "You") agree to be bound by these Conditions of Use.
If you do not agree to these terms, you must not use this website or its services.
1Nature of the Platform
CanProTrades.ca is an online marketplace platform that connects individuals and businesses seeking trade-related services ("Clients") with independent tradespersons and trade companies ("Tradespersons").
CanProTrades:
- Is not a contractor
- Is not an employer of Tradespersons
- Does not supervise, direct, or control Tradespersons
- Is not a party to any agreement between Client and Tradesperson
All agreements, arrangements, payments, disputes, and outcomes are strictly between the Client and the Tradesperson.
2Independent Contractors
All Tradespersons listed on CanProTrades.ca are independent contractors and are not employees, agents, partners, joint venturers, or representatives of CanProTrades.
CanProTrades assumes no responsibility for:
- The quality of work performed
- Timeliness of services
- Licensing status
- Insurance coverage
- Certifications
- Regulatory compliance
- Worksite safety
- Damages of any kind
3No Endorsement or Guarantee
Listing on CanProTrades.ca does not constitute endorsement, certification, recommendation, or guarantee of any Tradesperson.
CanProTrades makes no representations or warranties regarding:
- Skill level
- Experience
- Professional qualifications
- Licensing
- Insurance
- Reputation
- Legal compliance
Users engage Tradespersons at their own risk.
4"Verified" Status
Some users may be designated as "Verified."
Verified means only that CanProTrades has connected with the Registered User to confirm that the individual is a live person and not a bot.
Verification does NOT mean that:
- Qualifications have been confirmed
- Certifications have been validated
- Licensing has been checked
- Insurance has been verified
- Experience has been authenticated
- Background checks have been performed
CanProTrades does not verify the truthfulness or accuracy of any Tradesperson's qualifications, credentials, or claims.
CanProTrades assumes no liability whatsoever for the use of any User (Tradesperson or Company), whether verified or not.
5User Responsibility
Clients are solely responsible for:
- Conducting their own due diligence
- Verifying licenses and certifications
- Confirming insurance coverage
- Requesting references
- Executing written contracts
- Ensuring compliance with local laws and building codes
You acknowledge that hiring a Tradesperson involves inherent risks, including property damage, financial loss, personal injury, or unsatisfactory work.
You assume full responsibility for those risks.
6Limitation of Liability
To the fullest extent permitted by law, CanProTrades, its directors, officers, owners, employees, affiliates, and agents shall not be liable for:
- Direct damages
- Indirect damages
- Incidental damages
- Consequential damages
- Special damages
- Punitive damages
- Loss of profits
- Loss of business
- Property damage
- Personal injury
- Death
- Legal costs
- Disputes between Users
Arising out of or related to:
- Use of the website
- Engagement of a Tradesperson
- Work performed
- Misrepresentation by a User
- Negligence of a Tradesperson
- Criminal acts of a User
- Breach of contract between Users
Your sole remedy for dissatisfaction with the service is to discontinue use of the platform.
7No Warranty
CanProTrades provides its services "AS IS" and "AS AVAILABLE."
We make no warranties, express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy of information
- Reliability of Users
- Continuous availability of the website
We do not guarantee that the website will be secure, error-free, or uninterrupted.
8Indemnification
You agree to indemnify, defend, and hold harmless CanProTrades and its affiliates from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the platform
- Your hiring of a Tradesperson
- Your dispute with any User
- Your violation of these Conditions
- Any injury, damage, or loss related to services arranged through the platform
9Dispute Resolution Between Users
CanProTrades is not responsible for resolving disputes between Clients and Tradespersons.
We reserve the right (but not the obligation) to remove users from the platform at our sole discretion.
10User Content and Representations
Users are solely responsible for any information posted on the platform.
By using CanProTrades, you represent and warrant that:
- All information you provide is accurate to the best of your knowledge
- You will not post misleading, fraudulent, or unlawful content
- You will comply with all applicable laws and regulations
CanProTrades is not responsible for false or misleading information posted by Users.
11Payment Responsibility
All payments are strictly between Client and Tradesperson unless otherwise stated.
CanProTrades does not guarantee payment, completion of work, or satisfaction of services.
12Termination
We reserve the right to suspend or terminate access to the platform at any time, without notice, for any reason.
13Governing Law
These Conditions of Use shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
Any disputes relating to the platform shall be subject to the exclusive jurisdiction of the courts of that Province.
14Modifications
CanProTrades reserves the right to modify these Conditions of Use at any time. Continued use of the platform constitutes acceptance of the revised terms.
15Entire Agreement
These Conditions constitute the entire agreement between you and CanProTrades regarding use of the platform and supersede any prior agreements.
